Welcome to Solyra® Glow Roses! These Terms of Service ("Terms") govern your access to and use of the Solyra® Glow Roses website located at https://solyraglowroses.com (the "Site") and any products or services offered by Solyra® Glow Roses ("Company," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Site.

By accessing or using any part of the Site, you agree to become bound by the terms and conditions of this agreement. If you do not agree to all the terms and conditions of this agreement, then you may not access the Site or use any services.

We strive to be as accurate as possible in the descriptions of our products, including the "Solar Glow Roses." However, we do not warrant that product descriptions or other content of the Site is accurate, complete, reliable, current, or error-free. All descriptions, images, specifications, and prices of products are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. We make all reasonable efforts to accurately display the attributes of our products, including the applicable colors; however, the actual colors you see will depend on your computer system, and we cannot guarantee that your computer will accurately display such colors.

In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, we shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, we shall issue a credit to your credit card account in the amount of the incorrect price.

5. Order Acceptance and Cancellation Rights

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline your order for any reason. We also reserve the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. We may require additional verifications or information before accepting any order. We reserve the right to cancel an order at any time if we suspect fraud or other unauthorized or illegal activity.

All payments must be made at the time of purchase. We accept various payment methods as indicated on the Site. By submitting an order, you represent and warrant that you are authorized to use the designated payment method and authorize us to charge your order (including taxes and shipping fees) to that payment method. If the payment method cannot be verified, is invalid, or is otherwise not acceptable, your order may be suspended or canceled.

The Solyra® Glow Roses name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Solyra® Glow Roses or its affiliates or licensors. You must not use such marks without the prior written permission of Solyra® Glow Roses. All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners.

SOLYRA® GLOW ROSES, ITS AFFILIATES, AND ITS LICENSORS DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

IN NO EVENT SHALL SOLYRA® GLOW ROSES, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SITE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE; (III) ANY CONTENT OBTAINED FROM THE SITE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

You agree to defend, indemnify, and hold harmless Solyra® Glow Roses and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Site, by you or any person using your account and password; or b) a breach of these Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of [Your State/Country, e.g., the State of California, United States], without regard to its conflict of law provisions. Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration in [Your City, State/Country, e.g., Los Angeles, California] using the English language in accordance with the Arbitration Rules and Procedures of [e.g., Judicial Arbitration and Mediation Services, Inc. ("JAMS")] then in effect, by one commercial arbitrator with substantial experience in resolving intellectual property and commercial contract disputes, who shall be selected from the appropriate list of JAMS arbitrators in accordance with such Rules. Judgment upon the award rendered by such arbitrator may be entered in any court of competent jurisdiction. Notwithstanding the foregoing, each party shall have the right to institute an action in a court of proper jurisdiction for injunctive or other equitable relief pending a final decision by the arbitrator.

12. Severability Clause

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Site, and supersede and replace any prior agreements we might have between us regarding the Site.
